This guide will help students navigate LLEAP3

Introduction

This Navigating LLEAP3 guide provides an overview on potential resources to use during the LLEAP3 course.  This guide provides helpful resources to use in conjunction with the CWRU School of Law LLEAP3 Transactions and LLEAP3 Litigation course.  This guide is for informational purposes only; it does not constitute legal advice.

Litigation Helpful Hints

Recall the Motion for Summary Judgment and Motion to Dismiss from LLEAP 1 and 2.

On your first page remember to identify: Court, Case Number, Judge, Plaintiff's name, and Defendant's name.

Do not forget a Certificate of Service, Attorney signature block, and Exhibits.

Each case may have a mix of good and bad facts for your client.  Highlight your good facts and downplay the bad facts.  Do not lie but do advocate for your client.

Transactions Helpful Hints

You must be organized with the goal to avoid conflict and clarity.

You need to brainstorm but never against your client.  When brainstorming answer the following: Who, WhatWhere, When, Why, How, and What if not.

When writing a contract make sure the format is the same throughout the contact.  For instance: there should be headings for every subsection.

Use the appropriate writing tool: Covenants, Rights, Declarations, Conditions, Representatives, and Warranties. Each of these writing tools are unique and serve a purpose.

Clear up any ambiguous language.  Examples: Sentence Structure and Passive vs Active Voice. Remember you want clarity in your contract.

Create a Define Terms section in order to establish a common vocabulary for terms which are repeated throughout the contract.

Finally, make sure all parts of the contract are included.  For instance: Title, Preamble (Introduction), Recitals, Consideration Sentence, Substantive Terms, General Provisions (Miscellaneous), Signature Blocks, and Exhibits.
